Total vs. Partial Disability

When you are declared permanently disabled, your doctor will determine whether you have been totally or partially disabled. Total disability is when you lose the capacity to gainfully work all together, and you will never recover to the point where you will be able to do so again.

When you are partially disabled, you still have the ability to work, but in a limited capacity, and you will remain injured regardless of treatments or healing time for the foreseeable future.

Depending on which disability you are awarded, you could receive benefits amounting to a portion of your average weekly wages, or weekly payments for life at the state’s total disability rate in order to compensate you for the wages you have lost as a result of your injury.

Workers’ compensation can also provide you with benefits for:

  • Authorized medical treatments pertaining to the injury resulting in your disability
  • Reimbursement for travel to and from doctor visits for your injury
  • Assistance obtaining new employment and training if you cannot fulfill your old duty

Scheduled or Unscheduled Awards

If your injury is scheduled, you can receive up to two-thirds of your weekly wages for a number of weeks determined by the schedule your injury falls under, up to a maximum of 160 weeks.

For example, if your doctor declares you 50% disabled, you are eligible to receive up to 150 weeks of payments.
